Fasken Settlements specializes in luxury home and wood cabin construction services. Our comprehensive service offering includes, but is not limited to:

• Custom home design and construction, including full architectural and engineering services
• Luxury wood cabin construction, incorporating traditional and modern building techniques
• Complete renovation and remodeling services for existing structures
• Sustainability consulting and green building implementation
• Project management and construction oversight
• Interior design and finishing services
• Smart home technology integration
• Landscape design and outdoor living space creation

4. Contract Formation and Project Execution

4.1 Initial Consultation

All projects begin with a comprehensive consultation to understand client needs, preferences, and project scope. This consultation may be subject to a fee, which will be credited toward the project if a contract is signed within 60 days.

4.2 Proposal and Estimates

Following the initial consultation, we will provide:

• A detailed project proposal outlining scope, materials, and approach
• Preliminary designs and concept drawings
• Cost estimates valid for 30 days from issuance
• Projected timeline and major milestones

4.3 Contract Formation

A binding contract is formed only when:

• Both parties have signed the written agreement
• The initial deposit has been received
• All necessary permits and approvals are secured
• Material specifications have been agreed upon

5. Payment Terms and Financial Obligations

5.1 Payment Schedule

Our standard payment structure, unless otherwise specified in writing, consists of:

• 30% initial deposit upon contract signing
• 25% upon completion of foundation work
• 25% upon completion of structural elements
• 15% upon completion of interior finishing
• 5% final payment upon project completion and inspection

5.2 Additional Costs

Clients may incur additional costs for:

• Changes to approved plans or specifications
• Unforeseen site conditions requiring additional work
• Premium material upgrades requested after contract signing
• Extended storage of materials due to client-caused delays
• Additional administrative or professional fees

6. Warranties and Guarantees

6.1 Structural Warranty

We provide a comprehensive 10-year structural warranty covering:

• Foundation and structural elements
• Load-bearing walls and support systems
• Roof structure and water-tightness
• Major structural defects affecting habitability

6.2 Systems and Fixtures Warranty

A 2-year warranty covers:

• Plumbing systems and fixtures
• Electrical systems and fixtures
• HVAC systems and controls
• Windows and doors
• Built-in appliances (manufacturer's warranty may extend longer)

7. Project Timeline

While we strive to meet all projected timelines, we are not liable for delays caused by:

• Weather conditions
• Material shortages
• Force majeure events
• Regulatory delays

8. Intellectual Property

All designs, plans, and documentation remain the intellectual property of Fasken Settlements. Clients receive a license to use the designs for their specific project only.

9. Liability

Our liability is limited to the value of the contract. We maintain comprehensive insurance coverage but are not liable for:

• Consequential losses
• Delays outside our control
• Third-party actions

10. Termination

Either party may terminate the contract with 30 days written notice. In case of termination:

• All completed work must be paid for
• Materials ordered must be paid for
• A reasonable cancellation fee may apply

11. Privacy

We collect and process personal data in accordance with our Privacy Policy. By using our services, you consent to such processing.

12. Dispute Resolution

Any disputes shall be resolved through:

• Initial good faith negotiation
• Mediation if necessary
• Binding arbitration as a last resort

13. Governing Law

These terms are governed by the laws of Ontario, Canada. Any legal proceedings shall be brought in the courts of Toronto, Ontario.

14. Changes to Terms

Neither party shall be liable for any failure or delay in performing their obligations where such failure or delay results from any cause that is beyond the reasonable control of that party. Such causes include, but are not limited to:

• Riot or civil unrest
• Government regulations
• Labor disputes
• Pandemic or health emergencies

16. Severability

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.
